The data controller

Your personal data is collected and processed, in accordance with the Law and the RGPD Regulation, by We Green Europe SPRL (hereinafter referred to as “We Green”) whose registered office is located at 1 Ikaroslaan, 1930 Zaventem, Belgium.

Scope of the privacy statement

We Green makes sure to protect the personal data of all its stakeholders with the greatest possible care and to only process personal data in a fair and proportionate manner. This privacy statement applies to our customers, partners, and website visitors for personal data collected and processed by We Green.

Processing of personal data

Personal data can be defined as any information that makes it possible to identify a natural person, directly or indirectly. You can provide us with your personal data in the context of the following activities, for the corresponding purposes and on the basis of the reasons indicated:

Use of “cookies”: When you visit our website, certain data is automatically collected (IP address, browser type and model, browser type and model, time zone, operating system, all information concerning the pages that the user visited on the website, including the URL) in order to improve your navigation. Cookies can be deactivated in the settings of your web browser.

Making contact : By completing the contact form on the website, you consent to We Green processing your name, email address and question or message. If you contact us directly (by email, telephone or letter), we will process your contact details and the content of this correspondence. We only use this information to sufficiently deal with your question or message.

For the provision of our products and services: When you enter into a contractual relationship with We Green to acquire certain products or services, we collect your contact and billing data for the strict purpose of providing our services and managing our contractual relationship.

For sales and marketing purposes: We Green may use your name and contact information for direct marketing campaigns, to inform you about promotions regarding products and services that We Green provides, and to contact potential future customers. We may also use the data to make targeted offers, for example by email, or to display an advertisement on our own website. We send these communications or place the ads, based on the legitimate interest of We Green, if we find that you are interested in or benefit from our services or products.

Survey/Satisfaction form: Based on the legitimate interest of We Green, we may use your contact details in order to evaluate, judge and improve the services offered to you. For this purpose, we may send you questionnaires or surveys, or ask you to complete a satisfaction form.

Other relationships: We collect the contact details of our current or future suppliers and partners. We process this information to conclude our agreements and to manage our relationships or collaborations. This treatment is therefore based on the conclusion and execution of our contracts and business relationships. We Green considers your personal data to be confidential and is committed to treating it only in a manner compatible with the purposes for which the data was originally collected.

Your rights as a data subject

At any time, the person concerned has the possibility to exercise their rights as described in the General Data Protection Regulation (GDPR). The person concerned may exercise the following rights:

Right of access

You have the right, at any time and free of charge, to access your personal data and to request a copy of the personal data that We Green has about you.

Right to rectification

You always have the right to have incorrect personal data corrected or to have incomplete personal data completed.

Right to erasure (“right to be forgotten”)

You can request that your personal data be removed from We Green's systems.
The request to erase your personal data cannot always be granted due to contractual or legal obligations. We Green will take these obligations into account when responding to your request.

Right to object

You have the right to object to the processing of your personal data. We will stop processing unless we can prove that there are legitimate and compelling reasons for the processing or the exercise of legal rights. You can also object to processing for direct marketing purposes, so that personal data will no longer be processed for these purposes.

Right to withdraw consent

For the processing of your personal data collected by We Green with your consent, you can withdraw your consent at any time. However, the withdrawal of your consent does not apply to the processing previously carried out by We Green.

Right to restrict processing

In certain cases, the person concerned has the right to obtain the restriction of the processing of his personal data. We will continue to store your data, but we will limit its use. For example, you can submit this request when you think that your personal data is inaccurate or that the processing by We Green is unjustified. We should only grant these requests in specific cases, as defined by law.

Right to data portability

The data subject has the right to receive personal data concerning him or her, processed by We Green, in a structured, commonly used and machine-readable format and/or to transmit this data to another data controller without We Green obstructing it.
These rights can be exercised free of charge by sending an email to info@we-green.africa. We are committed to responding to your request within one month of receiving it. We may first ask for additional information in order to confirm your identity and to ensure that the request is from you.

Right to file a complaint

Disclosure to third parties

We Green will refrain from disclosing or selling the personal data of the persons concerned to third parties as well as from publicly disclosing the personal data of the persons concerned, except in the following specific cases:

- Personal data may be shared between the various branches of We Green in the event that this transfer is necessary for the provision of our products or services in accordance with the predetermined purpose.

- Personal data may be shared with third party service providers to whom We Green has outsourced certain processing activities. In any case, they are limited to the processing of your personal data in accordance with our instructions and if necessary, a data processing agreement will be concluded so that they are obliged to comply with all the obligations required by the applicable data protection legislation.

- If required by applicable laws or regulations.

With respect to international transfers of personal data and processing outside of the European Economic Area (EEA), your data is only transferred to other branches or parts of We Green in third countries, such as software providers and cloud or mailing services, only when permitted by applicable data protection legislation. We guarantee appropriate guarantees that your rights are also respected by the data recipient outside the EEA in accordance with an adequate level of data protection.

Retention of your personal data

We Green does not keep your personal data longer than is strictly necessary for the achievement of the purposes for which we received the data, for the execution of a contract or to fulfill a legal obligation. Retention periods differ depending on the type of processing and the purpose for which the personal data was collected. Personal data that we collect based on your consent will be retained for as long as your consent remains valid. We keep customer and supplier information about your purchases for as long as reasonably necessary to fulfill our agreements, to comply with our legal obligations (such as accounting and tax obligations), and to resolve disputes or enforce agreements. Therefore, this personal information is kept for the duration of our contractual relationship and for a maximum of 10 years thereafter. Personal data may be retained for a longer period of time if there is a legal or regulatory reason for doing so, or for a shorter period of time if the data subject objects to the processing of their personal data and if there is no longer a legitimate reason for keeping them. We guarantee to provide only limited access to archived data and to delete or anonymize your personal data if the retention period has expired.

Security and confidentiality of your personal data
